$225,000 Settlement – Maximum Underinsured Motorist Limits Recovered After Initial Insurance Coverage Denial
In August 2026, Attorney Kevin Smith secured a $225,000 settlement for a 37-year-old mother who sustained serious and permanent injuries in a motor vehicle collision. The traumatic crash occurred when a negligent driver rear-ended the client's vehicle on Route 2 in Preston, Connecticut, forcing her car off the road and into a concrete wall. At the time of the collision, the client had her three children in the car with her. As a result of the crash, the client suffered multiple severe injuries, including surgeries to address a tear in her right wrist and right cubital tunnel syndrome.
After the negligent driver’s insurance company offered its $25,000 liability limits, our client pursued the $225,000 of remaining underinsured motorist coverage under her own automobile policy. Nevertheless, our client’s insurance company initially denied her underinsured motorist claim, alleging that her policy had been cancelled 1 day before the accident because she allegedly failed to provide personal information. Attorney Kevin Smith aggressively and successfully disputed this denial. By successfully overturning the wrongful coverage denial, Attorney Smith recovered the full remaining underinsured motorist policy limits of $225,000.
