$90,000 Settlement - Woman Fractures Wrist - Fall at Mohegan Sun

Attorney Kevin Smith secured a $90,000 settlement for a 63 year old woman who fractured her left wrist after slipping and falling on chocolate sauce while walking in Mohegan Sun. As a result of the fall, the client was forced to undergo left wrist surgery, which required the insertion of a distal radius plate along with the placement of nine screws/pegs. The client also had a permanent scar at the surgical site measuring approximately 3 inches. Smith argued that the metal hardware remained in the client's left wrist, which caused fear and anxiety concerning any increased/worsening issues associated with it.

Smith demonstrated that the Mohegan Tribal Gaming Authority was responsible for the maintenance of the area where the client fell. Mohegan Sun ultimately admitted liability and the case settled for $90,000.
